I have read Justice Ombija's ruling. I believe the reason he ruled the way he did is because not all relevant international law materials and arguments were put before him especially by the AG. Such materials and arguments would have been necessary particularly because very few of our judges are trained in international law. Ombija unfortunately limited himself largely to local law and did not fully consider Kenya's international law obligations under the Vienna Convention (on diplomatic immunities etc) of which Kenya has ratified and is part of Kenyan law.

I believe Article 98 clears any doubts we had on which way the ruling should go.
