It's interesting how this warrant of arrest issue will play out. Judicial independence and non-interference of one arm of the government with the other. Apparently Al Bashir expects the Government of Kenya to rubbish the court ruling which obviously undermines the doctrine of seperation of powers as enshrined in the constitution.

Whatever stance Kenya took wasn't going to change two facts. 1. Bash is and will always be a wanted suspect, 2. Kenya (or any African country is never going to arrest him). So why rock the boat? Affeys statement that we invite him is neither here nor there due to fact 2.

I wonder what your ruling would have been if you were the High Court judge deciding on a case filed by some people against Al Bashir, knowing well that Kenya is a signatory of the ICC and is also bound by some international laws and treaties that it agreed upon and are accommodated in the Kenyan Constitution.

Are we also not bound by the African Union which does not side with ICC on this one?

The problem is not the judiciary. The problem is not Kenya. The problem is not Ombija. The problem is Bashir. He overeacted angrily as it seems his ego was badly hit. It also now seems Bashir is sudan and sudan is Bashir. Who would want to invest in such a country? It is impossible to have the appeal case heard - leave alone determined in two weeks and we can only wait to see Bashir confirm his 'punishment'..Then what? Kenya will still survive. Since July 2011, Sudan's proximity to Kenya is no more important than that of Chad or Central Africa Republic.
