Question:
You secure a loan from a credible bank on the strength of the now 'fake' title as collateral, being a normal Kenyan you do the only normal thing and tell the bank to auction the land to recover their money.

a) Will the bank still come after you?

b) Will you be blacklisted on the Credit Reference Bureau records?

As Kamiri says, its yes to both.

You would have obtained money "by false pretense" by purporting to have a title when in actual sense you do not have one. The bank will chase you and then you can chase whoever sold the "fake" land to you.

But Gathige, they failed to perform due diligence on their part. They should fire their representative who signed the forms.

Is the customer responsible for the incompetence of their employees?

You can run but not hide! One day they catch up with you so its best to pay what you can. Remember you can acknowledge a debt of 5m and pledge you are only capable of paying 1 bob a month in good faith!

I only qulified to be deducted the amount am currently paying, my salo hasnt increased in the past year.
What now make them think that I can pay an amount higher and still live my bear minimum life?

The loan contract is between you and the bank. You are the one liable not Mlolongo bros or anybody else. Two things or Acts to remember while buying land RTA & RLA and under which you are obtaining the land.

I don't think anyone got a loan against that land. I think they got their loans on the strength of their salaries. Therefore, the bank[s] will still chase the borrowers.

Nevertheless, when you place some property as collateral for a loan, bear in mind that should you be unable to pay, the bank will auction your property and if the money raised is not enough to cover the loan balance, the bank can still come after you for the balance. Remember that you borrowed MONEY not PROPERTY!

Banks will set auctioneers on you who will come after everything you own, your sons ben10 t-shirts, your daughters hannah montana, your wife's wedding band all your suits, your inherited land in shagz. best bet divorce your wife and put everything in her name or kids asap
