Out of curiosity would we be having any Wazuan affected?We need to give moral support incase there is one.

Where any of the persons is holding a title and it turns out that such title was legitimately issued he/she might have some luck in the courts - years from now unfortunately.

We are living in the digital age, where every parcel of land should be digitized with all it's entitlements, and database linked from Ardhi House to all City/Municipal/town Councils Lands and Planning Departments. The era of allocating and selling land to more than two people, selling disputed land should be long gone.

Could Wazuans please read the two draft Land Bills and make comments: May be your and my comment will amount to something in the final Bill. We have to fight this monster, for this country to be a better place to buy, build, and bring up families.

Public Notice
Ministry of Lands is implementing the Constitution of Kenya 2010 through, among others, preparation of draft legislations on land. The Ministry is committed to facilitating participation of the people of Kenya in this process.

In this regard, we wish to notify members of the public that the Ministry, in consultation with stakeholders, has prepared two draft bills to meet provisions of Article 68 of the Constitution of Kenya 2010. These are: -

Draft Land Bill – to revise, consolidate and rationalize land laws; to provide for the sustainable administration and management of land and land-based resources and for connected purposes.

The two draft Bills can be downloaded from the Ministry of Lands’ Website http://www.ardhi.go.ke/ >Downloads> DRAFT LAND BILLS >Lands Bill 24th October 2011 and Land Registration Bill 24th October 2011. All members of the public are invited to visit the website, read the draft Bills and forward comments to Kenya Law Reform Commission, Attorney General and Commission for Implementation of the Constitution.

@ jaggernaut... the problem we are facing is a local authority delinked from ministry of lands ofcouse due to hunger for power/impunity/corruption.
All local authorities should only approve buildings on lands without disputes. It should be their responsibility. The clause that says 'approved SUBJECT to the land not having any encumbrances' should be deleted as in the case with other countries.
There is no way you can separate ministry of lands with local authorities in the issue of land since teach land is slightly different on the ground and the ability to adjust these small differences lies with the local authority .
Ministry of lands want to have power to allocate land but they don't have necessary structures to manage this. Mavoko council have the necessary structures but cant fight such a huge monster so they just lie low and watch as things unfold.
KAA comes in the middle of the fights/confusion and reclaims its land back.
Verdict-professional bodies-LSK,AAK,ISK etc should come in and fill in the void of leadership to avoid these catastrophes. Numerical Machining Complex, EAPCement land e.t.c are next if someone does not intervene now.

I think there is more to the story here..where does the property block in question lie ?
1.Does the land lie in Machakos County (Mavoko) or in Nairobi county ? is it an attempt to change a county boundary?

2.If the boundary is in question where do the constitutional boundaries lie.?

3.Every public document and map I can find online(including google) indicates the Unjum rectangle (Ungani,Jumbo ,Mloloongo) is in Machakos county.

4.My concern is the disregard/ impunity of the executive towards the Judiciary. Pending Case court..or are they in cahoots.

5.All Titles and searches are issued in Nairobi, if we can not trust the title for the land we sleep in soon our faith in the Shilling we trade in falters as its implied it can change overnight

6.KAA may have issued notices, but how many people know their block numbers on the title? A law should be introduced that any advert for evacuation must include a map.


I think we need a jicho pevu on this.."the matter is that today it was syokimau , in 8 yrs time the next government will say the title for your land in CBD was issued illegally ,then bring down the hse and no compensation.

I shudder at the thought..

Yes there are.Some people think they are too smart here wait till they come for yours and say your title is just a piece of paper after changing the boundary.

My heart goes out to the Wazuans directly affected; and to all in general. I was there and just couldnt stay on to watch that shameful heartless exercise. I cannot begin to imagine how it might feel like.

There was to be a court ruling today. Anyone heard how it has gone? Why didnt KAA and cabinet wait for this ruling? Are Kenyans now supposed to have confidence in this investigation?
