Officially its still a public holiday as per the Public Holidays Act Cap 110 of the Laws of kenya. But Muthoura would have none of it.

Alteration or addition of public holiday.
34 of 1964, 21 of 1966, 1st Sch., L.N.190/1971, 2 of 1984. s. 4, 9 of 1990. PART I

@ tebes, but you know any law that is inconsistent with the katiba is void to the extent of its inconsistency!

You are correct. However, note that there is a difference between public Holiday and National Days(Enshrined in the constitution) .

Costitution says;

(3) The national days are––
(a) Madaraka Day, to be observed on 1st June;
(b) Mashujaa Day, to be observed on 20th October; and
(c) Jamhuri Day, to be observed on 12th December.
(4) A national day shall be a public holiday.


Note Labour day, Just like Moi day are both public holidays unless ammended by parliarment.
