Ocampo loses case against suspect

If Muthaura's defense is anything to go by, Ocampo has no case against him. His lawyers Faal and Ogeto made a good showing on Saturday. Ocampo is just hot air. He is worse than Lumumba Otieno. He has now guaranteed no justice for victims of PEV.

This is the story I got from an insider and confirmed separately.

Initially, Amolo had told Ocampo that if he were to summon Uhuru and Rutu, they would not go to the hague because they are too proud. That would have ensured an arrest warrant was issued and as you know, have such a warrant over your head would remit your movements around the world seeking political support and finance especially from western countries.

Ocampo followed raila advice but uhuru and ruto were smarter.

Read some of the facts in Muthaura's defence.

A typically combative Mr Khan dismissed the prosecution’s evidence as a tissue of lies. “The flotsam and jetsam of the prosecutor’s errors should not be allowed to flow into the river of justice to pollute it,” he said.

The central contention in Mr Khan’s case was that the planning meetings the Prosecution team has cited did not take place. He drew on records put forward by the G Company of the General Service Unit which keeps a record of all visitors at State House to discount the prosecution’s claims.

He also played video and tabled minutes of meetings which Mr Muthaura attended to account for his movements on the day the meeting is said to have taken place.

His phone records for January 3, 2008, when he is said to have made a call in support of the Mungiki attacks in Naivasha and Nakuru were submitted to the court to combat the allegations.


He said the Prosecution claimed one meeting took place on Saturday, January 27, 2008, a day which he said was a Sunday in that year.

He also cited a Prosecution witness who spoke of a meeting attended by CID director Joseph Kamau during the election period. Mr Khan tabled a letter indicating that Mr Kamau had retired a year earlier.

At a press conference on Wednesday in The Hague, the NGOs urged the office of the prosecutor to reopen investigations into the sexual crimes committed in Kibera and Kisumu after the 2007 elections, saying victims had been let down by Mr Ocampo’s investigative team.

“Our review of the reasons judges keep rejecting gender-based violence charges are the generous use of secondary material and public reports by the office of the prosecutor,” said Ms Brigid Inder, the executive director of Hague-based Women’s Initiative for Gender Justice.

Where investigators do a shoddy job that is sure to cost them a case. Indeed, the surest way to sabotage a prosecution is to carry out shoddy investigations.

Conversely, lawyers build their reputations from the way they gather evidence and interrogate and corroborate, and sieve and sift it.

Again, how lawyers assemble and interrogate witnesses builds or destroys their reputations as courtroom performers.

Notice that lawyers for Finance minister Uhuru Kenyatta, postmaster-general Hussein Ali and Public Service head Francis Muthaura repeatedly taunted Mr Moreno-Ocampo, and boasted that they had, unlike the prosecution, carried out investigations.

What investigations did Mr Moreno-Ocampo carry out? He did not interview any of these three suspects and yet he knew pretty well that the Rome Statute demands he gathers and inquires into both incriminating and ameliorating evidence.

The prosecutor did not produce phone records to back up claims that the suspects made telephone calls, yet these are readily available from the mobile phone providers.

I am dumbstruck

All along I expected, nay, knew, Mr Moreno-Ocampo had these records! Alas, I am dumbstruck!

The prosecution has alleged the military ferried fighters to theatres of combat but produced no records to back up this.

In government and military no vehicle leaves its parking lot, fuels and exits without the written say-so, complete with itinerary, from the bosses.

It is why I cannot believe Mr Moreno-Ocampo has not made these records available and, worse, appears not to have them. But remember he confidently dragged that most secretive of establishments into the murder of those it is supposed to protect.

Second, Mr Moreno-Ocampo made good use of the report of the Justice Philip Waki-led inquiry into the post-election violence.

In this report, Justice Waki, at every turn, recommended further investigations, but, it appears, Mr Moreno-Ocampo’s team had no stomach for such work.

And we were told the prosecution carried out investigations in Kenya. I am yet to see and hear their evidence.

I see neither smoking gun nor bombshell. Mr Moreno-Ocampo does not have the sextet over a barrel; he appears to be scrapping the barrel for evidence.

On Wednesday, as lawyer Steven Kay QC (Queen’s Counsel) graphically defended Mr Kenyatta as a preacher of peace and demonised Prime Minister Raila Odinga as a war monger, he sarcastically mocked the failure of the prosecution to investigate its own case.

How about Mr Moreno-Ocampo’s witnesses? When lenient the defence has derided them as anonymous. Otherwise, they have been depicted as hunting with the hounds and running with the hare, drunkards, nomadic fortune seekers and — wait for it — career witnesses.

Raila not agent of change after all

Over the years, the PM has made it a career of reminding Kenyans of the inviolability of freedom of speech, freedom of the press, freedom of expression, freedom of conscience, freedom to hold different opinions, a fair and functioning judicial system and a functioning democratic system. Indeed, he suffered greatly for championing these ideals. These are the reasons why I have supported him over the years.

Early this morning (August 12, 2011), I received information that on July 6th, 2011 when my staff went to the Prime Minister’s Building to collect my leave allowance, a junior employee at the Human Resource department at the OPM was boasting that I would not be returning to work because I had been fired. My staff did not have the courage to tell me of the rumours in case they turned out to be just rumours.

I am also aware that I was not allocated office space at the PM’s Building last year due to mortal fear by the “power men” from Nyanza that I was becoming too powerful and influential. These “power men” believed that my “power” and influence” were emanating from the proximity I had to the PM.

They thought that discarding me at the NHIF Building in Upper Hill, would dilute the perceived power. However, when they noticed that I continued to discharge my functions with complete commitment, diligence and distinction, the power men panicked and resorted to bestiality. But because they are both cowardly and dishonest, they could not face me with their fabrications. They waited until I was on leave to execute their nefarious plans.

So, quite clearly, the PM and those around him simply wanted to “sacrifice” me for parochial, mischievous and malicious political reasons. The PM has acted both dishonourably and disgracefully.

But in doing so, they acted inhumanely, did not follow due process, and grossly breached my legal and constitutional rights. Nobody can justify these acts. I am not a dog that can be brutalized without consequences.

I shall protect and uphold the rule of law and the Constitution. Those who fear democracy, the rule of law and refuse to uphold the Constitution have no business pretending to represent the ideals of the new dawn.

When it comes to issues of justice, truth, respect for human rights, the rule of law and constitutionalism, I have no other option but to be uncompromising.

I know that the people of Kenya and God are on my side on this. The inhumane and bestial way I have been shunted has touched many people. Everybody knows the positive contributions I have made and will continue to make for the well-being of this country.

To the people of Kenya, I want to say: I shall never bend and serve at the whims of parochial selfish interests.

I really don't think this thread is about Raila so i don't understand why you're defending him. From what i've been able to get its all about Ocampo's case at the ICC. MK has also been mentioned severally by the defense team.

The violence started as a result of inciting the ignorant folks, and we know very well that those who incited are not in Hague.They regard themselves as reformers while they carry innocent blood with them everywhere.
