The one thing that you don seem to get is that event though it is a confirmation hearing, the prosecution has to prove that without a reasonable doubt that they can take the case to the full. Just proving that the witness was in the police force is not good enough. They have not shown that he was actually involved in the commandeering of the rioters and killers. Of course as a police officer you are trained in small arms skills. that should not be a surprise to anyone. We may be third world but we dont have a boy scout police force.

Katwa is using a very efficient mode of defence. He must have looked at the evidence and realised that by pointing out holes in the prosecution evidence about the whereabouts of the chairman of the network, then there is no way his underling client could have been there. It works and is far much easier. the whole case is hinged around the meetings that HR chaired.

@Marko the transcripts provided by Ocampo are from 8th January 2008 to 31st January 2008. This is not the period the prosecutor has build his case upon.

Also very disppointed in Ocampo, he seems to have handled his preparations for this trials in a very simplistic manner. It would be very disappointing if he did not confirm the whereabouts of Ruto and Co, before making the claims that they were at a planning meeting.

Could be a case of Ocampo underestimating the capability of Kenyans and the level of our sophistication. He probably thinks kenya is like DRC.

Interesting proceedings. Could Ocampo be keeping back his best foot, even when he could be failing at this point and no chance for next stage! Unless he knows this stage is walkover.

So he gave evidence that he does not intend to use? Don't tell me that you cannot smell a sewer rat there. He is the one to prove beyond a reasonable doubt that he has a case..He hasn't done that. THE BURDEN OF PROOF IS ON THE PROSECUTOR.

Me thinks Kenyans have put unfounded faith in Ocampo. I don't think the guy did thorough investigations and may not have enough evidence that can convict. But he doesn't need to prove guilt now. All he has to show is that he has some credible case against the suspects. He might be able to meet that lower threshold and move to trial. I suspect his main aim is simply to have the guys charged - for him that will something to beat his chest about. Getting convictions is a totally different ball game - Convictions are not easy to get at the ICC or the ICTY or ICTR.

Ohh yes..we put alot of hope on Ocampo.but to say the least,he hasn't been convincing so far.I also fail to see why he fails to release any of the so called damning evidence againist the suspects.probably he doesn't have any.truly ,it will be very sad for we kenyans if this case is thrown away just because Ocampo failed to conduct proper investigations.However this serves to remind us that the answer to all our problems lies within us Kenyans,not outside.

And again we see just how flimsy the evidence by Ogambo is. Looking at the prosecution trying to trap the Pastor, you could see that they can see their case crumbling right in front of them. You could literary see them pooping in their pants. This is better than most courtroom dramas I have watched in a while.

the more this circus goes on the more ICC shows how it poorly understands the political climate, the peopleand other matters in kenya! they know nothing other than the ambiguous statements in the charges...have they brought in anything new? i feel that they are just typical UN employees.
the sooner we are able to trust ourselves in getting our own justice the better!
