RENT INCREASE

Last month, we had a power black out. some fool decided to take advantage of the unfortunate situation and steal fuel from the transformer. i hear when that happens and the people around do not mulika the mwizi, kplc punish u by making u stay in darkness for the longest time. our "generous" landlord decided to install a generator for us. the next day he sent a notice that he has increased rent by 500bob per household maintainence and fuelling the generator. there are twenty households. so every month, he makes 10K. other than this one time we had no elec for 3days, the other blackout incidents occur once or twice every 3months and for 1hr max. is the increase in rent justified? if it is, should it be that much (ie 500bob)? any lawyer out thgere who can clarify what the law says about increase in rent???

As per what you have stated above the landlord has not increased the rent but he is charging you for the maintenance and upkeep of the generator. 500/- is fair enough.

A TRANSFORMER is generally maintenance free coz it has no moving parts. But if your people keep on siphoning the coolant... expect some cost. I would say 10K is on the lower side. May be he will collect 500/= for one year which looks OK. Mlika mwizi "..I am because we are. "― Ubuntu, Umtu,

he must be a very patient landlord, a generator to support all of you must have a price tag of more than 1M....the only generous part of him is charging you 500 bob.

@mmunguti they guy did you a favor... 500bob = 3beers... He has taken a risk and bought a generator, if after some months he makes a profit... fair enough, thats what businessmen do... This in unreal !! Wacha uongo, no landlord can install a generator then charge only 500. Where is that you live anyways?

Unless you remain in darkness during the blackouts, you can either put up or move out. He/she will also probably raise rent at end year claiming wear and tear on the generator anyway, but decision remains yours. My 500 cents, cheers! @MMunguti Its nothing personal its just businessAnyway this landlord is smart, For that one month you were without power he saved you from all that inconvenience. Anyway who pays for the petrol/diesel ?if its the landlord then I think you got a good deal 500/= is fair when you consider the alternative i.e buying your own generator or solar system.. @ mmunguti well am not a lawyer but i think you are at liberty to go to the rent tribunal. wachana na hawa ma bwenyeye who are saying the rent increase is justifiable without offering you legal options.... 1. A landlord shall not increase the rent charged to a tenant for a rented premises without giving the tenant at least ninety(90) days written notice of intention to do so. an increase in rent is void if the landlord has not given the notice 2. On the other hand, A landlord may increase rent if the landlord has, (a) carried out or undertakes to carry out a specified capital expenditure in exchange for the rent increase; (b) provided or undertakes to provide a new or additional service in exchange for the rent increase; or (c) taken into account inflationary trends in the economy Common sense is the most evenly distributed quantity in the world. The landlord has 3 VALID reasons for raising rent: Capex = generator Additional service = Uninterupted Power Supply Inflationary Trends = Big issue in Kenya. He only needs one reason. Next time, Brother/Sister, MULIKA MWIZI! How do u mulika mwizi when the transformer is far away from where one lives? I think KPLC should think of protecting their property the way safcom is protecting their boosters.

considering for that 1 or 2 month you would have paid electricity bill its fair the question is when kenya power decides to to replace the damn thing will the price go back down

Security became an issue, a Watchie was hired and we have KK on speed dial for that 500bob ikaongezwa. so rent ikakua 20,500. i have no problem with that coz security is a major issue and the securty is present at all times. when the generator was brought, we were sent a note to say 500bob imeongezwa kwa rent. so when paying rent, we should pay 21,000. my problem is. we rarely have power blackouts. and when we do its usually for an hour max. i dont understand the 500bob every month. isn't the landlord using using us to recoup HIS investment? when i move out, i wont go with the generator. a generator is classified under group IV and depreciates at 12.5% so for it to depreciate completely and become unusable, it will take 8yrs. y cant he spread the cost over that period of time? divide by the number of households? then bill us every month for the fuel used for that generator in that month?
