That is very cheap. Your friend is best served going for it and should In fact have the lawyer to draw up an agreement and they both sign on that fee so that the lawyer does not ask for more later on. Adoption is rather long and hectic by the way, before you go to court, you need to deal with adoption societies or something like that.

The adoption agency has its part. And the lawyer will have her part; draft her own documents, research etc. No competent lawyer will let another person draw her pleadings for her and no ethical and sensible lawyer will let an unqualified person draw pleadings for her. You may probably get one for 5-10k but remember you mostly get what you pay for.

And no matter involving going to court cannot be simplified by 'it is just for you to go to court'.

@mkenyan,

yes,one can draw her pleeading becouse you know better than the lawyer... but the lawyer has to redesign it to comply with the court format.... a Good lawyer cannot take any pleading to court before letting you go throug it..

But thier also many con people,if a lawyer ask you to pay deposit then pay him for each court attendance,he/She will take you round over and over gain until you are tired..ONE should be able to tell you the total cost pay some deposit, and the rest you pay as the case continues.

Shee- my post on drawing of pleadings was just to point out to Blackberry that it cannot be that the lawyer's work is just to go to court and nothing else. I otherwise agree with you though it would be interesting to get a non-lawyer who can do pleadings better than a lawyer.

On the cost, advocates (not merely lawyers) are guided by the Advocates Remuneration Order. It provides what one should charge and to charge less than that is unethical and illegal.

The problem is that advocates do undercut then when it is come to do the work, they are busy getting more instructions from other clients who are probably haggling with them to undercut. Thus your work is never done competently. That is why I say,pay well and get your work done.

But you have to be very careful,if an advocate agrees to charge less he can later on demand for the balance as per the remuneration order and if you do not pay he shall tax.

Taxing involves the advocate going to court and the court making a decision based on the Remuneration Order. Unlike other cases in the judicial system,it is a very fast process and the advocate filing his bill in court to the auctioneers paying you a visit can take from a couple of month to one year .

The assumption folks make...

is that the lawyer's fees are always on the higher side....

and thus..

we have clients who haggle....

like we are in a market place.....

the best advice to any client...

is that.....

professional services are best treated that way.........

if i feel that 50k is just sufficient to run my firm......

then it will be 50k...

if i feel 100k to move me to consider taking up such instructions.....

why should you run to the nearest market to complain....

you will get ..

what you paid for....

treat other professions with the respect these deserve......

if you were my client...

i would have billed you 250k......

for your nuisance.....

Blackberry, the only way I see the cost being low if you file outside Nairobi is if you instruct an advocate practicing outside Nairobi and he charges you less. This is because the fees payable in the court are the same all over Kenya. The court fees FYI are not usually that high.

But with all due respect to advocates practicing outside Nairobi, the ones in Nairobi are most likely to be up to date with the developments of the law etc.

And TRS is right. People in Kenya are not ready to pay advocates like the professionals that they are. In fact it is not uncommon to find a person spending hours with an advocate on consultation without paying a cent. Try visiting a dentist or a doctor and you pay just so that she can tell you how much you should be paying for her services.

Well well, surely, its agive and take... its market place... you purchase according to your ability,BK.. feel free to go for what you can affond

if i feel 50k is too much for your friend,. That her,she should go for what she can affond... why take aloan to pay 250K while as you can get the same at 30-40k..

There are those who buy tomatoes at Nakumat and others go to Marigit for the same tomatoes... by the way,the market is already flooded.

A while Ago,i had two different cases in Court....I paid atotal of 70k both... the respodent paid a total of 300k for the same case... and i won in both cases..

So,go to the lawyer you can afford.
