Who tells you that even that issue of ratified treaties does not need legislation? It has to be legislated by Parliament otherwise any goon in government can tie us up with all manner of treaties. no one tells me ratified treaties must have local legislation. i know that. its time we got off that fallacy that if a warlord is to told to face justice, then there will be more chaos and war in retaliation. that is blackmail ati if bashir is arrested sudan will descend into unparalleled chaos and it is only kenya that would suffer. the old days of baba na mama wa taifa who was the only one who held the country together are long behind us. a country is bigger than an individual. the individual can and will go but the country remains, you know that dont you? we should now be exporting our experiences to other nations..

on a different tangent, why are people focussin on obama? isnt my voice against bashir just as important? people should stop looking towards usa every single time there is an issue at hand then get their bearings based on what americans say!

The Right Honourable Prime Minister attended a promulgation thanksgiving prayer service in Kinoo on Sunday, where he took to the pulpit and registered his “disapproval” with the presence of Sudanese President Omar Hassan Al Bashir in the country on Friday, despite the ICC noose hanging over his head.

Firstly, I would wish to remind any Martian who is reading this article that Mr Odinga is one of the two Principals at the head of the Government of the Republic of Kenya. Casually, this means that the PM is responsible for everything that happens within the borders of this country, and anything that the government commits to internationally.

After bringing the Martians up to speed, let me now remind all of us that the Cabinet of the grand coalition government made history last week, when it held two sittings in the same week. In fact, it met on two days in a row – Tuesday and Wednesday; Truly historic. Their second meeting was primarily to focus on the arrangements that had been put in place for Friday, August 27 when Kenya was to usher in a new Constitution.

One can only expect that one of the items on the agenda at Wednesday’s Cabinet meeting was titled “VIP guests” in which the protocol officers at the Foreign Affairs Ministry and the Cabinet Office should have prepared a proper brief for the 40 men and women present at the meeting.

Surely, the name Sudan must have appeared on the briefing papers, didn’t it? Alongside Uganda, Tanzania, Comoros, Rwanda, Ethiopia, Somalia, Djibouti and other member nations of IGAD, EAC, COMESA and such bodies where Kenya plays a critical role.

The emergent question would therefore be; did the Prime Minister, or indeed Prof Anyang Nyongo and James Orengo register it to the Cabinet that they did not want Khartoum to be included in the invitations list?

When these three gentlemen come out to the public complaining that Omar Hassan Al Bashir should not have come to Kenya, whose collective intelligence are they insulting, if not Kenyans?

It is my considered opinion that Raila, Nyongo and Orengo should explain to us why THEY invited Al Bashir to Kenya in the first place, before telling us that ODM was not aware of his visit. Who is ODM, and what does a political party have to do with State invitations?

Was ODM consulted about the particular artillery that the military was planning to display at Uhuru Park? I guess not.

Was ODM consulted about the jumbo flag that has now been hoisted at Uhuru Park as a commemoration of the birth of the Second Republic? I bet not.

Was ODM consulted about the off-tune group of musicians who “entertained” us at Uhuru Park? I guess not, or probably that is why they sang so badly. Lol!

Isn't it curious that it was none other than an ODM Cabinet Minister who was assigned to accompany Bashir to Uhuru Park?

Najib Balala strode majestically alongside the visitor to the dais. His PNU comrade Amos Kimunya escorted Yoweri Museveni.

These roles, I imagine, were assigned in Cabinet.

The point here is that the government (read Cabinet) invited Omar Al Bashir to Kenya knowing full well about the ICC arrest warrants, the AU resolution regarding his arrest, Kenya’s central role in the Sudan peace process and the forthcoming referendum on the independence of our immediate neighbour Southern Sudan.

The government has explained its position on this matter more than once. It is up to Kenyans and the international community to buy this reasoning.

However, somebody needs to remind our beloved Prime Minister (who looks most likely to become President, according to opinion polls) as well as other “ODM” leaders who sit on the Cabinet that Kenya is now different. The days of making one decision collectively behind closed doors and later coming out to play to the gallery are gone. They died when Kenyans voted on August 4, and were buried when the President appended his signature to the new Constitution.

Kenyans are mature. They will no longer entertain small time political games.

You sat in the Cabinet and approved the invitation of Omar al Bashir. Live with it. Kenyans will judge you collectively as the Cabinet, and not as ODM or PNU.

please note: no one is saying that Bashir is innocent, the question is. Would you arrest a President of a Nation in your country and not expect repercussions?
2) why arent the other nations namely UG and Chad that accommodated the head of state not facing this kind of nonsense...i will tell you the reason....Kupenda ku-ramba behinds of white people. thats what kenya does best.
which country has ever rubbished its own laws and institutions and paved way for toothless international bodies to investigate it even after being told that it should put its house in order? Kenya. which country welcomes international law to sort out its internal mess? Kenya. FYI: each time Moreno comes into Kenya its a minus for Kenyans, the effeminate nature of our legal system yet we cheer and enjoy as we look like clowns to the rest of the world.

Big time goof this one was.

I dont need the west to know that it is wrong to pledge abide by ICC resolutions by blatantly dishonour the same.

We ought to have politely and wisely kept Bashir away from the Nairobi event. There are many ways in whuch this could have been done.

Good note. But what Kenyans need is not an explanation; it is a judiciary undertaking. When people break the law they should not have a chance at rationalizing their crime. Peace in Sudan and bullcrap, NO! Under new constitution Kenya is bound by the treaties it signs. End of story. But there can even be additional offenses - the deceptive implementation of secrecy to clear Wilson airport for exclusing landing of the ICC fugitive could have been exploited by other misfits to land in Kenya the same way - well, they could perhaps have confronted security forces at the port, but that's a confrontation that would have caught all of us unawares. It was a breach of security. Let the constitution be shown to work! Criminals should be judged by courts of law.

so, Kenya should have invited him (under the old constitution)- telling him that our law is silent on what to do with him. And as soon as MK promulgated the darn thing into law, we change our tune and Say!! oops!! the current silly unachievable bunch of laws say otherwise.

Did anybody else notice as I did that a certain veteran Agwambolet here had initially supported the Bashir visit – posted here.

Unfortunately for him Raila took time to state his position, controversial/hypocritical as it was.
When it came, he was opposed to Bashir invite!

The said fanatic has since reviewed his view to conform with Enigma!

We continue to believe that those responsible for war crimes in Sudan should be held accountable for their actions. But we are working closely with the government of Sudan on ways to resolve the situation in Darfur," he said.
