I spoke to a lawyer (just a friendly conversation without all details) who said that KK might be able to approach the courts to 'deposit' the KShs 530mn or so... [Or issue an irrevocable Bank Guarantee]

KPRL can then be compelled under a certificate of urgency to allow crude to be processed at the old rates... any 'difference' to be deposited with the courts...

ERC wud have no cause to suspend KK... MoE would also shut up... Then the court/arbitration process would start...

The bottom line is that Kk shld nw act . Either pay the deposit or whatever ....coz from the locks of things erc isnt jokin .

I agree with qw! When you have two evils, you chose the lesser evil. Nani kali kati ya ManU na Arsenali...sorry Kenol Kobil vs ERC/KPRL. Let me explain, Bravado mentality display by KK is finally toning down. Infact they will have to PAY..period. Not because they want to pay but because it is the only option. In as much as KPRL is inefficient, the consequence of hardline stance is grave.. suspended/revoked license is even more worse.

Therein lies the difference in our positions... KK should NOT pay KPRL directly... but pay the 'court' while the dispute is resolved thru arbitration or court process...

Also KK has a KShs 5bn lawsuits against KPRL... & should they win... KPRL will be BANKRUPT...

KPC is appealing a KShs 4bn arbitration ruling... LOL... I hope KPC loses the ruling so KK can wipe the floor clean with KPC's bum!!!

ERC can't afford to lose kk in the Kenyan market. The vacuum that 20% market share would be quite devastating for our fragile yet growing economy. Pure vitisho!!
